What is a Lasting Power of Attorney (LPA)?

A Lasting Power of Attorney (LPA) is a legal document that allows someone you trust to make decisions on your behalf if you’re no longer able to. For instance if you become incapacitated from illness, accident, or age-related conditions.

There are two types: Property & Financial Affairs LPA – for decisions about money, bills, pensions, property, or investments. Health & Welfare LPA – for decisions about medical care, treatment, and living arrangements. Without an LPA in place, your loved ones could face stressful delays and legal costs if you lose capacity.

These are the situations that bring most families to this page, not after planning ahead, but after something’s already happened:

  • A sudden stroke, with no warning, leaves a spouse locked out of a joint mortgage account because it was only ever in one name.
  • A parent’s early dementia diagnosis means the window to set up an LPA is closing, sometimes within weeks, because capacity has to be in place when it’s signed.
  • An adult child wants to help manage a parent’s care fees, but the bank won’t speak to them without legal authority, even with the family’s full agreement.


In every one of these, the family’s only route without an LPA is applying to the Court of Protection, which is slower, costlier, and considerably harder on everyone than setting one up in advance would have been.

What Happens If You Don't Have One?

Many people assume a spouse or adult child can automatically step in if something goes wrong. Under the law in England and Wales, that isn’t true. If you lose capacity, whether through illness, an accident, or age, your family can’t access your bank accounts, make medical decisions, or manage your care unless they’ve been legally appointed.

Without an LPA already in place, the only route is an application to the Court of Protection for a deputyship order. It typically takes several months, costs considerably more than setting up an LPA in advance, and the court, not your family, decides who's appointed.
